These Terms of Service ("Terms") are a legal agreement between you and Job Elf Technologies, Corp., a Florida corporation ("Job Elf", "we", "us" or "our"), which runs jobelf.com and its related services (together, "Job Elf").
By creating an account, checking the box or choosing "Continue with Google" when you sign up, or using Job Elf in any other way, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use Job Elf.
If you use Job Elf on behalf of a company or other organization, you agree to these Terms for that organization, you confirm that you're authorized to bind it, and "you" includes that organization.
Please read section 18 carefully. It says that most disputes between you and Job Elf will be settled by binding individual arbitration, not in court, and that you give up the right to bring or join a class action. You can opt out of arbitration within 30 days of first accepting these Terms, as section 18 explains.
1. What Job Elf is, and what it isn't
Job Elf is an online platform. People looking for work ("candidates") build a profile from their résumé, with photos and an optional intro video. Employers search those profiles, post jobs, and message, interview and hire candidates. Both sides are "users".
Job Elf is only a venue that lets candidates and employers find and talk to each other. In particular:
- Job Elf is not an employer, recruiter, staffing firm or employment agency. We don't find jobs for anyone, place anyone in a job, or act for either side.
- Job Elf is not a party to any application, interview, job offer, employment relationship, contract or payment between users. Any of those is solely between the users involved.
- Job Elf is not a consumer reporting agency. We don't do background checks, credit checks, reference checks or drug tests, and nothing on Job Elf is a "consumer report". Employers may not use Job Elf to get one.
- Job Elf doesn't verify what users tell us or post (identities, résumés, experience, education, licenses, companies, jobs or pay) unless a page clearly says that a specific item was checked, and even then only to the limited extent it describes.
2. Who can use Job Elf
- You must be at least 18 years old and able to form a binding contract.
- You must give accurate information, keep it up to date, and use your own real name. One person, one account.
- Employers must represent a real, lawful business and be authorized to hire for it.
- You can't use Job Elf if we've suspended or closed your account before, unless we agree in writing, or if the law of the United States or your country doesn't allow you to.
- Job Elf is offered for use in the United States. If you use it from anywhere else, you do so on your own initiative and you're responsible for following your local laws.
3. Your account
- Keep your password and sign-in methods safe, and turn on two-factor authentication if you can. You're responsible for everything that happens in your account, whether or not you authorized it, until you tell us it's been compromised.
- If you sign in with Google (or another provider we offer), that provider's terms also apply to your use of it.
- If you think someone else has used your account, tell us straight away using our contact form.
- You may not sell, transfer, lend or share your account.
Company teams
An employer account belongs to a company team. The team's Owner and Admins can invite people, give them roles, change roles and remove them. The company is responsible for everything its team members do on Job Elf, including how they use candidates' information. When a team member's account is deleted or removed, the company's jobs, notes and other records stay with the company.
4. Candidates
Your content
Your résumé, profile, photos, intro video, transcript, messages and anything else you add ("your content") stay yours. To run Job Elf, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt (for example resizing photos or converting video), display and distribute your content. This includes:
- showing your profile to the people your visibility setting allows, including search engines when your profile is Public;
- showing it to companies you apply to, and to anyone you send a share link to;
- having our service providers process it for us, for example reading your résumé with an AI service; and
- including your profile, without your name or photo, in AI-assisted searches by employers, unless you turn that off in your profile preferences.
This license ends when you delete the content or your account, except for (a) copies in backups until they're overwritten, and (b) anything already shared with another user (for example a résumé an employer downloaded or messages you sent), which we can't take back. We won't use your name, photo or video to advertise Job Elf without your permission.
You confirm that you own your content or have the right to post it, and that posting it doesn't break any law or anyone else's rights.
Keeping it accurate
- Your profile must be true and about you. When Job Elf builds a draft from your résumé, you must check and correct it before you publish it. You are responsible for everything your published profile says.
- Don't put anything in your profile or résumé that you don't want employers to see, and never include your Social Security number, other government ID numbers, bank or card details, passwords, or medical information.
Photos and intro videos
- Photos must be recent, of you alone, and suitable for work. No filters, logos, text or group shots.
- Intro videos are 15 to 60 seconds long, show you introducing yourself, and have no music, filters or effects.
- Every photo and video gets an automatic check before it appears, and anything inappropriate is turned down straight away. When the check can't decide, our team reviews it. Our team may decline or remove any photo or video that breaks these rules, and you can ask us to take another look at a decision through our contact form.
Who sees your profile
You choose whether your profile is Public, Private or Hidden, whether to hide your current employer's name, and what each share link shows. Anyone who has a share link can see what that link includes, so share links carefully and turn off any you no longer need. Applying to a job shares your profile and résumé with that company until you withdraw the application. Our Privacy Policy explains exactly who sees what.
5. Employers
Your company
- The information you give about your company and jobs must be accurate, and you must be authorized to act for the company.
- We may verify companies or employers (for example by matching your email domain to your company's website, or by reviewing documents you send), and we may remove a verification at any time. A verification badge only means we did the specific check it describes. It isn't an endorsement of the company, its jobs or its practices.
Using candidates' information
Candidates trust us with their information. When you view a profile, open a résumé, run a search or talk with a candidate, you may use what you learn only to consider that person for a real, open position at your company. You must not:
- sell, rent, share or publish candidates' information, or give it to anyone outside your company's hiring process;
- add candidates to marketing lists, or contact them about anything other than a position;
- copy profiles or résumés into another database or service, or keep them longer than you need them for hiring;
- try to identify or contact a candidate in ways they haven't chosen, or get around a locked or hidden profile;
- use candidates' information for background checks, credit decisions, tenant screening, insurance or any purpose regulated as a consumer report.
Keep any résumés you download secure, delete them when you no longer need them for hiring, and follow every privacy and data-protection law that applies to you. You are solely responsible for your hiring decisions and for complying with all employment laws.
No discrimination
You must follow all federal, state and local employment and anti-discrimination laws. You must not use Job Elf, including candidates' photos, videos, names or languages, to screen, rank, reject or treat anyone differently because of race, color, religion, sex, pregnancy, sexual orientation, gender identity, national origin, ancestry, age, disability, genetic information, marital or family status, veteran or military status, or any other characteristic protected by law. Don't ask about these characteristics in messages, interviews, job posts or AI search requests.
Job postings
- Post only real, open jobs you're hiring for, with accurate titles, locations, requirements and pay. Where the law requires a pay range in job postings, include it.
- Never ask candidates to pay you or anyone else to apply, train, buy equipment or start work. Don't post pyramid schemes, commission-only roles described as salaried, or anything illegal.
- We review postings from companies we haven't verified before they go live. We may reject, close or remove any posting. Postings stop showing after 30 days unless you renew them.
Messages, interviews and profile views
- Messages and interview invitations must be professional and about a position. Don't send spam or bulk messages. We limit how many new conversations you can start each day.
- Candidates' email addresses aren't shown to you. Talk to them on Job Elf unless they choose to share their contact details.
- When you view a candidate's profile, the candidate can see that someone from your company looked (your company's name, not yours).
AI-assisted search and suggestions
Job Elf may offer tools that suggest candidates, rank search results or summarize how a profile matches what you asked for. These tools can be wrong or incomplete. Their output is a suggestion, not a hiring decision, and not a statement of fact about any candidate. You must review candidates yourself and make your own decisions. Don't include protected characteristics in your requests. If a law regulates automated tools in hiring where you hire (for example notice, consent or bias-audit rules), you're responsible for following it, including deciding not to use these tools.
6. Paid features
Today Job Elf is free to use. We plan to offer paid features for employers, such as subscriptions, paid job posts and credits that unlock candidates' full profiles. If you buy one:
- the price, what's included, and how long it lasts will be shown before you pay, and you'll have to agree before you're charged;
- payments are processed by our payment provider (Stripe) under its terms; we don't receive your full card number;
- subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel. You can cancel at any time in your billing settings, and cancellation takes effect at the end of the current period;
- credits and unlocks have no cash value, can't be transferred or exchanged for money, and expire as described when you buy them;
- except where the law requires otherwise, payments are non-refundable, including for partial periods and unused credits;
- prices don't include taxes, which you're responsible for; and
- we'll give you at least 30 days' notice before a price change affects a subscription you already have.
7. Things nobody may do on Job Elf
You must not:
- scrape, crawl, harvest or copy Job Elf or its content with bots, scripts or other automated tools, or use Job Elf's content to build a database, a product or a training set for an AI model (search engines may index public pages as our robots.txt allows);
- get around our visibility settings, locks, limits, verification, security or access controls, or access anything you aren't allowed to see;
- create fake or duplicate accounts, impersonate anyone, or misrepresent who you are or who you work for;
- harass, threaten, stalk, defraud, deceive, exploit or discriminate against anyone;
- use Job Elf to collect information about users for any purpose other than real hiring for a real position;
- send spam, chain messages, or advertising unrelated to a job;
- upload viruses or anything harmful, or probe, disrupt, overload or reverse-engineer Job Elf;
- use Job Elf to break any law, or to help anyone else do any of these things;
- misuse our reporting tools, for example by reporting people in bad faith.
8. Content that isn't allowed
Don't post, upload or send anything that:
- is illegal, or promotes illegal activity;
- is sexual, violent, hateful, threatening, harassing or defamatory;
- discriminates against anyone because of a protected characteristic;
- is false or misleading, including fake experience, fake jobs or fake companies;
- infringes anyone's copyright, trademark, privacy, publicity or other rights, or includes someone else's personal information without their permission;
- contains Social Security numbers, other government ID numbers, financial account details or passwords; or
- is spam, unrelated advertising or malware.
9. Moderation, reports and suspension
- Anyone can report a profile, photo, video, job, company or message. Our team reviews reports.
- We may remove or decline content, pause a profile, reject or close a job posting, remove a verification, limit features, or suspend or close an account, at any time and without notice, if we believe it breaks these Terms, puts anyone at risk, or could expose Job Elf or others to harm or legal liability. We'll usually tell you what we did and why, unless the law, safety or an investigation prevents it.
- To investigate a report, our team may read the reported conversation or message. Each time they do, it's recorded in our audit log.
- We don't promise to monitor or remove any particular content, and deciding not to act on something isn't approval of it.
- If you think we got something wrong, tell us using our contact form and we'll take another look.
10. Other users, and your dealings with them
You alone are responsible for your interactions with other users. Job Elf doesn't screen users, doesn't run background or identity checks (except any specific check a badge describes), and doesn't supervise what users say or do on or off Job Elf. Other users may misrepresent who they are, their experience, their company or a job, and some may act unlawfully or harmfully.
- Use good judgment and take sensible precautions before you share personal information, meet someone, accept or make an offer, or hire someone. Meet in public or professional settings, verify employers and candidates independently, and never send money or sensitive financial information to someone you met on Job Elf.
- Job Elf is not responsible or liable for the conduct, statements, content, jobs, offers, hiring decisions, payments, or employment practices of any user, whether online or offline, or for any loss, harm or dispute that results from them.
- If you have a dispute with another user, it's between you and that user. We may, but don't have to, try to help.
Release. To the fullest extent the law allows, you release Job Elf and its officers, directors, employees, agents and affiliates from any claims, demands, losses and damages of every kind, known and unknown, arising out of or connected with any dispute you have with another user or anything another user does. If you are a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." Residents of other places waive any similar law.
11. No guarantees about jobs or people
- We don't guarantee that you'll get a job, an interview, a reply, a hire or any number of views, applicants or results, or that any job, employer or candidate is suitable, genuine, qualified or safe.
- Information on Job Elf (including profiles, job posts, pay ranges, company pages, verification badges, AI suggestions and search results) is provided by users or generated automatically and may be inaccurate, incomplete or out of date.
- Links to employers' own websites or other sites go to places we don't control, and we're not responsible for them.
12. Job Elf's own property
Job Elf's name, logo, design, software and content (other than users' content) belong to us or our licensors and are protected by law. These Terms give you a limited, revocable, non-transferable permission to use Job Elf as intended, and nothing more. If you send us ideas or feedback, we may use them freely without owing you anything.
If you believe something on Job Elf infringes your copyright, email legal@jobelf.com with enough detail for us to find it and a statement that you're the owner or authorized to act for them.
13. Disclaimers
JOB ELF IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. To the fullest extent the law allows, Job Elf disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and quiet enjoyment, and any warranties arising from a course of dealing or use. We don't warrant that Job Elf will be uninterrupted, secure, error-free or free of harmful components, that any content (including AI output) is accurate or reliable, or that any defect will be fixed. You use Job Elf at your own risk.
14. Limits on our liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- JOB ELF WON'T BE LIABLE for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, revenue, wages, employment or business opportunities, data or goodwill, however caused and even if we were told they were possible;
- JOB ELF WON'T BE LIABLE for any loss or damage caused by another user or any third party, by content posted by anyone other than us, or by unauthorized access to your account or information that wasn't caused by our failure to take reasonable security measures; and
- JOB ELF'S TOTAL LIABILITY for all claims arising out of or relating to Job Elf or these Terms is limited to the greater of (a) the amount you paid Job Elf in the 12 months before the event giving rise to the claim, or (b) US$100.
These limits apply to every theory of liability, including contract, tort (including negligence), strict liability and statute, and even if a remedy fails of its essential purpose. Some places don't allow some of these limits, so they apply to you only as far as your local law allows.
15. Your responsibility to us (indemnity)
To the fullest extent the law allows, you will defend, indemnify and hold harmless Job Elf and its officers, directors, employees, agents and affiliates from and against all claims, demands, suits, losses, liabilities, damages, fines, penalties, costs and expenses (including reasonable attorneys' fees) brought by anyone else or arising out of or related to:
- your use or misuse of Job Elf;
- your content, or anything you post, send or share;
- your interactions, communications, agreements or disputes with any other user, including any application, interview, offer, hiring decision, employment relationship or payment;
- your breach of these Terms or of any law, including employment, anti-discrimination, privacy and consumer-protection laws; or
- your violation of anyone else's rights.
If you use Job Elf for a company, the company also gives this promise for everything its team members do. We may take over the defense of any claim at our own cost, and you'll cooperate with us. You may not settle any claim that affects Job Elf without our written consent.
16. Ending your use of Job Elf
- You can stop using Job Elf and delete your account at any time in your account settings. You can download a copy of your data there first.
- We can suspend or close your account under section 9, or if we stop offering Job Elf. If we stop offering Job Elf, we'll give you reasonable notice so you can download your data.
- Sections 1, 4 (for content already shared), 5 (how employers use candidates' information), 6 (amounts owed), and 10 through 19 still apply after your account ends.
17. Changes
- To Job Elf: we may add, change, suspend or remove features at any time.
- To these Terms: we may update these Terms. If a change is material, we'll tell you by email or with a notice on Job Elf at least 30 days before it takes effect, unless the change is needed sooner for legal or safety reasons. If you keep using Job Elf after it takes effect, the new Terms apply. If you don't agree, stop using Job Elf and delete your account. Changes to section 18 won't apply to disputes we already knew about.
18. Disputes, arbitration and class-action waiver
Talk to us first. Before starting arbitration or a lawsuit, send us a written notice by email to legal@jobelf.com. Describe the dispute and what you want, and include your name and your account's email address. We'll try to resolve it informally. If we can't within 60 days, either of us may start a formal proceeding. Any time limit to bring the claim is paused during those 60 days.
Binding individual arbitration. Except as described below, you and Job Elf agree that any dispute, claim or controversy arising out of or relating to these Terms or Job Elf (including whether a claim must be arbitrated) will be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or, if you use Job Elf for a business, its Commercial Arbitration Rules), as modified by these Terms. The Federal Arbitration Act governs this section. One arbitrator will decide the dispute. Arbitration may take place by video, by phone or on written submissions; if an in-person hearing is needed, it will be held in the county where you live (for individuals) or in Florida (for businesses). The arbitrator may award the same individual relief a court could, but only to you individually. Fees are paid as the AAA rules provide; for individual consumers, Job Elf will pay any filing and arbitrator fees beyond what you'd pay to file in court.
Exceptions. Either of us may (a) bring an individual claim in small-claims court if it qualifies, and (b) ask a court for an injunction to stop misuse of intellectual property, scraping, or unauthorized access to Job Elf.
Class-action and jury-trial waiver. You and Job Elf may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and the arbitrator may not combine more than one person's claims. You and Job Elf both give up the right to a jury trial. If this class-action waiver is found unenforceable for a particular claim, that claim (and only that claim) will be decided in court, after all arbitrable claims are arbitrated.
Mass filings. If 25 or more similar demands for arbitration are filed against Job Elf by or with the help of the same law firm or organization, they'll be administered in batches under the AAA's mass-arbitration rules, and the time limits for filing are paused while that happens.
Opting out. You can opt out of this arbitration agreement by emailing legal@jobelf.com, with the subject "Arbitration opt-out", within 30 days of the day you first accepted these Terms. Include your name and your account's email address. Opting out doesn't affect the rest of these Terms.
Governing law and courts. These Terms and any dispute are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute that isn't arbitrated will be brought only in the state or federal courts located in Florida, and you and Job Elf consent to their jurisdiction.
Time limit. To the extent the law allows, any claim must be brought within one year after it arises, or it's permanently barred.
19. General
- These Terms, together with the Privacy Policy and any terms shown when you buy a paid feature, are the entire agreement between you and Job Elf about Job Elf.
- If any part of these Terms can't be enforced, it will be enforced as far as possible and the rest stays in effect.
- If we don't enforce something straight away, we can still enforce it later.
- You may not assign or transfer these Terms or your account. We may assign them, for example in a merger, acquisition or sale of assets.
- We're not liable for delays or failures caused by events beyond our reasonable control.
- Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and Job Elf. There are no third-party beneficiaries, except that the people named in sections 10 and 15 may rely on them.
- You agree to receive notices and other communications from us electronically, by email to your account's address or on Job Elf. Send legal notices to us by email to legal@jobelf.com.
